Court proceedings filed by Comox Valley Regional District against shipbreaking

The Comox Valley Regional District (CVRD) has filed a notice of civil claim in a bid to stop ship-breaking operations in Union Bay.

The CVRD says they have received a number of complaints about the operations of Deep Water Recovery in its current location, according to a release. They are now seeking aid from the B.C. Supreme Court to stop the operations.

The board approved seeking legal action in mid-February. The district says the land where the operation is taking place is contrary to industrial marine zoning.

With the notice of civil claim filed, the property owner and operators will have the option to respond to the CVRD’s claim that shipbreaking is not allowed in that area.

“We have heard and understand the issues that have been raised regarding the property,” said Amanda Yasinski, manager of bylaw compliance. “The operations on the property are not allowed under the current zoning restrictions.”

The district says the court process is expected to take several months.
